Default legality of black headlights/tailights

I have a green Honda accord coupe 1998 4cl and i planned on making some mod on it for the summer, one of which was getting smoked tail lights. I looked online and it says that the law in NY states that as long as it visible from 1000feet it is legal; yet some people say you will get ticketed anyway unless u get after market light which are already tinted. i was thinking about getting some after market black taillights from eBay which are said to be SAE\DOT approved. they seem fine as they don't actually tint the actual light but does anyone have any experience with these things and can give me an insight.

all depends on the city/state you are in. you need to verify with local municipal codes, or even call the sherriff's department to verify.

it's somewhat subjective, and if they can't discern the brake lights, they can ticket you. 1000ft is a long way to discern black-out lights.

as far as headlights, you want to use them at night. many states allow black-out covers during the day but they must be removed at night. i've found that just painting the silver trim (disassemble them) makes them look darker but maintains their performance (don't paint the bulb optics).

the real issue is the loss of the reflectors. all tail lights and head lights have reflectors built-into them - so they stand out at night when the car is stopped/lights off and approaching headlights hit them. black out covers negate that and that increases danger/risk when the car is stopped. for that reason alone, you can be ticketed. and if someone is hurt in an accident when they plow into your parked car with the reflectors defeated, you could easily be held liable. in this day and age, people can sue for the slightest reason. i would sue someone who covered their reflectors if it prevented me from seeing their car (i.e. in fog or storm).

it's an issue of what risk/liability you are willing to accept to "look cool" to some people.
