Default 2007 Transmission shudder when cold

I have a 2007 Honda Accord EX-L V6 auto tranny. When the car is cold it seems to shift a little weird most noticeably from 2nd to 3rd gear. Its a slight shake through the whole car that i'm experiencing. Is this normal for these transmissions when the car is cold? As soon as it warms up its smooth and silky. However, last service on the car the fluid was very dark. Went to dealer and they did a flush and since then the fluid looks fine. but the shudder is still there. Should this be a concern or is this a normal thing with this transmission? Any help would be great. My warantee is up in 1,200 miles and i want to make sure i take care of the problem before thats up.

ANYONE KNOW A WAY OF CONVINCING THE DEALER TO GIVE ME THE NEW TRANSMISSION UNDER WARANTEE? any help on this matter asap would be greatly appreciated. I am running out of time.

I would get the problem documented at the dealership before your warranty expires. I don't know if they will have other suggestions. You should also ask if they did a drain/refill on the transmission or used a machine to exchange all of the fluid.
