Default Do I need new rotors?

I got new brakes and rotors about a year ago, and the dealer is telling me I need new brakes and rotors on the rear. There is heavy rust on the top ridge of the rotors, and on one the rust has come down onto the braking surface (pic below). I'm wondering if a new pad would be able to clean off this rust. The rest of the surface is clean, so I'm imagining that the pad has gotten smaller and that a new pad might clean the entire surface? The rust does look bad, but I don't feel any braking problems at all right now. My pads are between 2-3 mm, and I have a 03 accord sedan, 3.0L.

It looks like the caliper is stuck on the first picture. Or the brake pad is stuck.

I would use some silicone paste on the caliper pins to make sure the caliper is moving freely. Figure out why the brake pad is causing the wear in the first picture before replacing stuff.

Since the rotors are new, you may be able to have them machined to get them smooth. That second picture doesn't look too bad. When the rotors get machined, replace the pads.

What you don't want to do is replace the rotors and pads without fixing what is wrong with the caliper.
