Yeah, i'm hoping later I'll be able to look back and laugh at this.. but seriously, I'm on the verge of losing my mind and pulling out my hair over this stress...

I paid cash for the car at the beginning of the year, and did all my mods within the last 90 days (almost all of them in the last 60) all paid for and now I'm having this crap to go through... It is a lot of money to lose just cuz a body shop sucks. Granted, I could fix the damages myself, but that's not cheap either, and I shouldn't have to.

Yeah the TV station thing I was thinking of... I know FOX likes to get in peoples' business (tee hee) so we'll see what might happen from that. Now I gotta find numbers.

Jon's the insurance guy, but I bet they would not be amused to know that they paid for work that wasn't actually done. And they probably know how to apply pressure...
Ahh you responded while I was so I didn't see this...

Yeah the insurance cut me a check for the bumper at the beginning of the whole thing before they parted out the exhaust ($550) which I paid to the shop early to just get the cash exhange out of my hands (the insurance wouldn't deal with the body shop initially for some reason - they fought me pretty hard on that which I thought was stupid).

They ARE aware of the current state of the vehicle, and thus are going to pursue it on their own and told me not to worry about it... So that's fine, but still a pain that they were paid and didn't perform.



I just got a call from the adjuster about the new accident I just got in, and they are telling me they can't put my car into the shop until SK repairs the door properly and SK doesn't want to give me a rental on their dime. So we'll have to see what's going on soon enough, I have to make some calls.. Grrr

I won't cut checks directly to a shop either. It's your choice where you get it repaired, not the insurance company's. This is a PRIME example of why smart insurance companies don't tell you where to take your car. The only way I will pay a shop directly is if the repairs are either already done, or the car is already in the shop and the owner had authorized the repairs and signed a "direction to pay" at the shop.
Also, as an insurance adjuster, I don't care if you get the work done to your car or not. it's your money and your car. A lot of these small fender benders I myself admit I would pocket the cash and live with the few scratches it put on my bumper.
I bet the check had wording on it that said "the signing of this check constitutes a full and finalsettlement of any and all claims." That way once you signed the check, you have signed a release. So you can't come back to them 2 weeks later claiming your neck hurts and you have headaches and can't sleep at night.
Who was the insurance company by the way?

eSurance, who actually has been extremely helpful believe it or not... Really nice, willing, and quick..

Actually the check wasn't cut until the car was already -IN- service king when their roadside adjuster came in to look at the car -- so the shop was already selected and the car was in it before they cut me a check which is why I even tried to get them to pay SK directly.

And actually, the check didn't have any disclaimer of the sort; it was a plain jane check (printed of course) written to me, dated, and signed... looked almost like a personal check but had esurance name on there.

They have sent me this release in the mail though, but I haven't signed it specifically because this fiasco isn't squared away yet.

I was originally halfway impressed with their "cover their own @$$ as well as their insured's @$$" tactics but now I am not. What kind of idiot cuts a check on the spot then sends a release in the mail? Note to self: don't ever buy esurance.
I can understand why they still didn't want to cut the check directly to the shop though. Do you see how much trouble they have avoided and how much of it has been shifted to you? Did esurance pay for the rental?

yeah eSurance paid for the rental as well... originally it was a 2 day fix (4 hours but they had cars in front) but since SK hit my car they tried sending the entire 2.5 week bill to eSurance and they fought that pretty quickly...

Again, eSurance has been great to me even though they're not my carrier and they are at fault; so I can't really bash them, just though it was slightly weird how they handled it..

and yeah, the trouble HAS been shifted to me in one way or another..

and thanks 19accord97, i hope it comes out in my favor as well!

Spaz ..... I think the whole Dallas area is grateful that you don't have a loaded pistol in your car.
