Default New Buyer Problem

OK kids, here is the problem.......
About a week and a half ago, I bought a 2000 Accord EX. It was at a used car dealership near where I live. We asked about a dozen times if it had ever been wrecked or anything like that. The salesman says, "man I don't sell that **** here....I will put my hand on your baby's head and swear to it". It has a Carfax that is clean but...I have some family in the insurance business and they did some checking for me. It has a claim on it for 6300 dollars. What do I do? What can I legally do? We are in Kansas. Any help is GREATLY appreciated...

if you are absolutely sure that it is the same car,, have your friend make a copy of the claim ,, include vin # ,, take it to the person that sold you the car,, And if you do not want this car and would like to return it ,, tell him so , that yiou were mis informed ,,
if they do not want to negotiate GET A LAWYER ..

If you can, see if the accident has been reported to the DMV. Ifand only if the accident was reported to theDMV,you can makea claim to Carfax for their "buy back" guarantee....That's the way I understand it from Carfax's website.....

I don't know what Kansas laws are but if you don't trust the car I'd try to take it back ASAP and see what they say.... if they say that they didn't know then ask to see the Carfax, if the carfax is clean then there is no way that the dealership could have known which means they were lied to just like you, if they knew about it and lied that's non-disclosure but if they had no knowledge of the incident and you can't prove that they did then they told you everything as true as they knew it to be, and if the carfax was clean that just proves that they did everything they could to make certain it was right so they got "taken" when they bought it just like you....

Long story short: if they knew about it they are liable, if they had no idea then you can't fault them....

side note: if you couldn't tell without digging through your connections in the insurance industry then what's wrong with the car? and that $6300.00 may be for a transmission.....

The transmission, according to the dealership was "worked on" and is warranteed through the transmission place. It is leaking fluid and has been there once already. There is also a bright pink sticker on the inside of the front bumper under the hood (had to really look for it)and when asked about it, the salesman said that they had to repair a few things, but said repeatedly that it wasn't wrecked or salvaged orjunked.

if the car dealer is honest, they will give you a little discount. The same thing happened with my CL. Carfax showed clean title (no accidents) but insurance agent showed car was in accident in april 02 (2 weeks old) for a claim of $6XX and again in May 05 for a claim of $7XX. I showed them the insurance printout and they gave me $500 back (basically gave me plates and first mo car payment)

CallHonda of Americaand tell them your concerns about the dealer and the transmission. a 00 accord is under trans warranty 7 years 9 months from the in service date or 109K miles.

Dealer appears to be shady......

If the inspected the car like they claimed, any damage repair should have been immediately obvious to them.......

There is now more to the story....

We went to an internet company called Auto Check. I had never heard of it. It is kind of like Carfax. They showed that the car was sold at auction as having frame damage and unibody damage. Of course I was furious and called the dealer. He said to bring it back and he would research it some more. After thinking on it for a couple days, my wife and I went to a reputable dealership and bought another 2000 Accord, exactly the same with less miles. The body has some dings, but it also didn't have a new paint job like the first one. I am taking the other back to the dealership today.....hoping they don't give me a bunch of crap about it.
